1. Introduction

These Terms of Service (“Terms”) outline the agreement between Oz Pro Web Services (“we”, “us”, “our”) and the client (“you”, “your”) for Domain Registration and Transfer, Domain Email, Site Design and related one-off and/or ongoing Managed Services. By engaging our services, you agree to these Terms, and to act in good faith and in a timely manner.

2. Services Provided*

We provide site design and development services as agreed, including (where applicable):

  • Personalised consulting for site requirements, layout and design, both custom and templates.
  • Content publishing, including Image Design and Editing including Image Manipulation.
  • Basic Managed Services to provide site administration, billing and technical assistance.
  • Service Level Agreements (SLA) covering Response Times and Uptime Guarantees.
  • Mobile responsiveness for On-Premises Installations/Troubleshooting in the Canberra Region.

*Additional services not listed or not agreed and included in any quote may incur extra fees.

3. Client Responsibilities*

You agree to:

  • Provide all agreed content including text, images, logos, etc. in a timely manner.
  • Ensure all content supplied is owned by you or properly licensed.
  • Respond to communication and feedback requests within reasonable timeframes.
  • Review/Approve project work at key stages to confirm client satisfaction and project direction.

*Delays in providing requested/agreed content or approvals may extend project timelines.

4. Payments

  • A deposit of 10% may be required before work begins on more complex projects.
  • Milestone payments are due as agreed for client projects (Default Tax Invoice Terms are 7 Days).
  • Project progress may pause if payments are overdue, where no variation has been agreed.
  • All agreed payments are non‑refundable once work has commenced, except where required by law.

5. Revisions

Projects involving design or more creative/subjective decisions include up to 3 rounds of revisions unless otherwise agreed. Additional revisions or major changes to the agreed original project brief may incur extra charges.

6. Ownership & Intellectual Property

  • You continue to own all final website content and assets you provide.
  • We retain ownership of all custom design/concepts, code, and development until full payment of the final project Tax Invoice is received.
  • Following full payment, you receive a perpetual licence to use the completed site for your business.
  • We may showcase the completed site, with a basic description, in our site Projects page portfolio.

7. Third‑Party Services

If your project requires third‑party services (hosting, domains, plugins, etc.):

  • You are responsible for associated fees unless otherwise agreed.
  • We are not liable for outages, changes, or issues caused by third‑party providers.

8. Site Launch & Post‑Launch Support

Once the site is approved and launched:

  • Any bugs or errors reported within 7 days will be fixed at no extra cost.
  • Ongoing maintenance, updates, and support/recurring fees will be agreed.

9. Limitation of Liability

We are not liable for:

  • Loss of data, revenue, or business resulting from site use or downtime.
  • Security breaches or external hacking reasonably beyond our control.
  • Issues caused by third‑party services or client‑installed software.

Our total liability is limited to the amount paid for the project.

10. Termination

Either party may terminate the project in writing. If terminated:

  • You must agree to pay for all work completed in good faith up to the termination date.
  • Deposits are non‑refundable.

11. Amendments

We may update these Terms from time to time. The version in effect at the time of your project agreement applies.
